Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents No.3 and 4 to implement the order in Na.Ka.No.Aa1/798/2022 dated 18.12.2024 passed by the respondent No.1 within a stipulated time frame fixed by this Hon'ble Court.

By consent of both counsels, this writ petition is taken up for final disposal at the stage of admission itself.
2.Mr..J.Subbiah, Government Advocate (Crl.Side) takes notice for R1. Mrs. P. Vijaya Devi, Government Advocate takes notice for R2 to R12. 3.This Writ Petition is filed seeking a direction to the respondents 2 / 7
No.3 and 4 to implement the order in Na.Ka.No.Aa1/798/2022 dated 18.12.2024 passed by respondent No.1, within a stipulated time frame fixed by this Court.
4. The petitioner is a social worker and engaged in agricultural business. The respondents 5 to 16 are Government employees, who were posted in various Taluks of Kallakurichi District. During the course of their employment they misappropriated Government funds illegally causing severe financial loss to the Government. While so, the petitioner submitted a representation to the first respondent on 26.12.2022, seeking appropriate action against the respondents 5 to 16 for illegal misappropriation of Government funds. Pursuant to the said representation enquiries were conducted by the 3rd and 2nd respondents who in their enquiry reports found the respondent 5 to 16 guilty of misappropriation of Government funds. In fact, the second respondent directed the respondents 5 to 16 to repay the misappropriated amount of Rs.3,42,243/- The petitioner states that even though respondents 2 and 3 passed orders against the respondents 5 to 16 for misappropriation of Government funds, no action was taken towards the 3 / 7
implementation of the orders. Meanwhile, the third respondent in his order dated 25.03.2025, suspended the 13th respondent/C.Raja, while recommending criminal action against him. However, no further action was taken till date. Hence, the petitioner was constrained to file the above writ petition for the above relief.
5. The facts of the case are undisputed. It is seen that pursuant to the petitioner's representation dated 26.12.2022 to the first respondent, enquiry was initiated against the respondents 5 to 16 and the second respondent after due enquiry in his order dated 18.12.2024 found that the respondents 5 to 16 had misappropriated a sum of Rs. 3,42,243/- from Government funds and therefore directed them to re-pay the same. However further follow up action towards implementation of the aforesaid order was not initiated. In my view, the respondents 3 and 4 are bound to bring to a logical end, the order of the second respondent dated 18.12.2024. 4 / 7
6. Under the facts and circumstances of the case, I am inclined to issue a direction to the respondents 3 and 4 to implement the order dated 18.12.2024 of the second respondent, by following due process of law within a period of eight weeks from the date of receipt of a copy of this order.
7. This writ petition is disposed of with the aforesaid observation and direction. No costs.
