ORDER
This petition has been filed seeking directions to the first respondent to take disciplinary action and to register criminal case as against Kanchipuram Special Team Police, one Manikandan, Sub Inspector of Police and the fourth respondent herein.
Heard both sides and perused the materials available on record.
According to learned counsel for the petitioner, her husband was detained and brutally beaten by the respondent police and the 2/5
petitioner was not even allowed to see her husband and hence she seeks directions of this Court to the first respondent to initiate action against the Kanchipuram Special Team Police, one Manikandan, Sub Inspector of Police and the fourth respondent herein.
This Court, exercising power under Article 226 of the Constitution of India, only based on the allegations of the petitioner, cannot directly issue directions to initiate disciplinary action as sought for by the petitioner, without even any proof. However, since the allegations made against the police officials are very serious in nature, the petitioner is directed to give representation before the second respondent and the second respondent is directed to appoint a competent officer to conduct enquiry based on the allegations of the petitioner and monitor the enquiry proceedings. After completing the enquiry, the report shall be filed before the third respondent and the third respondent is directed to take action against the erred officials, based on the enquiry report. 3/5
With the above directions, this Writ Petition shall stand disposed of.
