The instant writ petition has been filed with a prayer for issuing a Mandamus to direct the respondents to consider the petitioner's representation dated 20.07.2023 and thereby direct the respondents to regularize the petitioner's service as a Sanitary Worker and fix the regular time scale of pay in pursuance of G.O.Ms.No.380, Health and Family Welfare Department, dated 28.06.2013.
2. The learned counsel for the petitioner submits that she has been working as a Sanitary Worker in the fourth respondent Hospital for more than 19 years. It is the further submission of the learned counsel for the petitioner that the fourth respondent has also recommended regularization of the 2/5
petitioner. In this connection, the petitioner sent a representation on 20.07.2023 to the respondents, which is yet to be considered.
3. At this juncture, the learned Government Advocate appearing for the respondents would submit that the petitioner is not an employee of the fourth respondent; however, she works under the NRHM Scheme. He would also fairly submit that they would consider the petitioner's representation within a reasonable time.
4. Heard the learned counsel for both sides and perused the materials available on record.
5. In view of the submission made by the learned Government Advocate, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 20.07.2023, and pass orders on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
