Respondents Petition filed under Article 226 of The Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling for the records of the 1st respondent in connection the proceedings No.6378/A5/2020 dated 11.08.2022 and to quash the same as far as to the limited extent of inclusion of the name of the 2nd respondent at Serial No.3 in the panel for promotion to the post of Sub Registrar, Grade-II for the year 2021-22 and the non-inclusion of the name of the petitioner therein in his place and to consequently direct the respondent herein to include the name of the petitioner in the place of the 2nd respondent herein in the panel for promotion to the post of Sub Registrar Grade-II for the

year 2021-22 without prejudice to his rights contained in the earlier W.P.No.12413 of 2022 and forthwith promote him as Sub Registrar, Grade-II and to grant him all consequential service and monetary benefits. ORDER

Heard both the petitioner and the 1st respondent.

2. The main grievance of the petitioner is that his name has not been in the panel for promotion to the post of Sub Registrar Grade-II for the year 202122.

3. The 1st respondent filed counter affidavit denying the averments made in the writ petition inter alia contending that the petitioner was inflicted with the punishment of stoppage of increment for one year each with cumulative effect in different orders in two independent departmental proceedings. It has been specifically stated in that the counter affidavit in para 5 that the name of the petitioner was not included in the panel for the year 2021-22 which is sought to be impugned, however, in the revised panel for promotion to the Sub Registrar Grade-II for the year 2021-22 issued on 25.09.2022 by the Inspector General of Registration, the name of the petitioner has been included at Sl.No.3 in the community turn of SC (Arunthathiyar).

4. In view of the fact that the name of the petitioner has now been included in the revised panel, the 1st respondent will have to consider the petitioner for promotion strictly in tune with the revised panel. This writ petition is disposed of accordingly with the above directions. No costs.
