O R D E R

The Criminal Original Petition has been filed seeking to quash the proceedings in C.C.No.2711 of 2024 pending on the file of the IV Metropolitan Magistrate Court, Saidapet.

It is the contention of the learned counsel appearing for the petitioner that the first petitioner married the second respondent in the year 2012 and that the second respondent has lodged a complaint alleging dowry demand against her husband and mother-in-law after a lapse of nine years. Based on her complaint, a case in Crime No.9 of 2021 was registered for the offences under Sections 498(A) & 406 of IPC and Section 4 of the Dowry Prohibition Act. She further submitted that the First Information Report itself was filed with delay and that all the allegations made in the complaint are false. Hence, she seeks to quash the charge sheet filed against the petitioners.

Learned Government Advocate (Criminal Side), on instructions, submitted that the trial in this case has been commenced and that LW1 has been examined.

Heard both sides and perused the materials available on record.

In such view of the matter, since the trial has commenced and substantial evidence has come on record, this Court is not inclined to quash the proceedings.

At this stage, the learned counsel for the petitioners sought the indulgence of this Court to dispense with the personal appearance of the second petitioner, as she is 85 years old.

Accordingly, the Criminal Original Petition stands dismissed. However, considering the age of the second petitioner, her personal appearance before the trial Court is dispensed with, except for the purpose of receipt of copies, answering charges, questioning under Section 313 Cr.P.C./351 BNSS, passing of judgment, or any other date as may be specifically required by the trial Court. Consequently, the connected miscellaneous petitions are closed.
