The petitioner, who was arrested and remanded to judicial custody on 06.03.2025 seeks bail in S.C.No.172 of 2019 for the offence punishable under Sections 341, 397, 364(A), 506(ii) of IPC in connection with Crime No.48 of 2019, registered on the file of the respondent. 1/4

2. The learned counsel appearing for the petitioner submitted that the petitioner was arrested on the strength of the NBW and he is in prison from 06.03.2025. He further submitted that the petitioner is a sole breadwinner of his family and due to his incarceration, his family is suffering. He further submitted that the petitioner undertakes to co-operate with the trial.

3. The learned Government Advocate (Crl. Side) strongly opposed for grant of bail to the petitioner stating that the case is pending from the year 2019. He further submitted that, there are totally eight accused and only A2 & A8 were secured and against the petitioner NBW was issued on 01.08.2024 and with great difficulty, he was secured only on 06.03.2025. He further submitted that if the petitioner released on bail, there is a possibility that the trial could be stalled.

4. Considering the facts and circumstances of the case and the case is pending from the year 2019 without any progress, this Court is not inclined to grant bail to the petitioner at this stage.

5. Accordingly, this Criminal Original Petition is dismissed. 2/4
