(CRIME NO.2/2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Modify the condition in order passed by Hon'ble Court dated 31.08.2021 in Crl.O.P.No.14422/2021 in so far as deposit of sum of Rs.25,26,359/- is concerned.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S S.SAI SHANKAR, Advocate for the petitioner, and of MR.A.GOPINATH, Govt. Advocate ( Crl. Side) on behalf of the Respondent, the court made the following order:- The petition has been filed to modify the conditions imposed by this Court vide order dated 31.08.2021 in Crl.O.P.No.14422 of 2021, wherein the petitioner was directed to deposit a sum of Rs.25,26,359/- to the credit of Co-operative societies account without prejudice to his defence before the Chief Judicial Magistrate-II, Krishnagiri.

2. This Court granted Anticipatory bail to the petitioner on 31.08.2021 imposing the condition that he should deposit a sum of Rs.25,26,359/-. Since the petitioner on his own volition agreed to deposit the said amount, anticipatory bail was granted. However, now the petitioner filed the modification petition to modify the conditions imposed in Crl.O.P.No.14422 of 2021 dated 31.08.2021. https://hcservices.ecourts.gov.in/hcservices/

3. In view of the above, this Court is of the opinion that the amount imposed by this court is based on the submission that the petitioner, on his own volition is ready to pay the said amount. In such circumstances, the present prayer of the petitioner for modification cannot be granted. Accordingly, this Criminal Miscellaneous petition is dismissed.
