THAMILSELVI CRIMINAL MISCELLANEOUS PETITION No.11177 of 2021 IN CRL OP.17906/2021 P.JAYABALAN [ PETITIONER ] Vs STATE REP BY [ RESPONDENT ] INSPECTOR OF POLICE, V-5, TIW-THIRUMANGALAM POLICE STATION, CHENNAI 600 040 Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition that the petitioner shall report the respondent Police Station every day at 10.am imposed in Crl.OP.No.17906/2021 dated 29.09.2021.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S D.SENTHIL KUMAR, Advocate for the petitioner and of MR. N.S.SUGANTHAN, Govt. Advocate (Crl. Side)on behalf of the Respondent the court made the following order:- Vide Order dated 29.09.2021 in Crl.O.P.No.17906 of 2021 modified the conditions imposed by the petitioner. This petition has been filed by the petitioner seeking relaxation of the conditions.

2. The Learned Counsel for the petitioner states that, the petitioner has complied the condition imposed by this Court and he has paid a sum of Rs.1,25,000/- by way of demand draft to the victim girl.

3. Learned Government Advocate (Crl.Side) appearing for the respondent, on instruction, submits that the petitioner has been complying with the conditions without fail.

4. In view of the above submission, this Court is of the considered view that the prayer as sought for by the petitioner could be acceded to.

5. Accordingly, the condition insofar as appearance as imposed by order dated 29.09.2021 alone stands modified and the petitioner shall appear before the respondent police as and when required and for interrogation on receipt of summons. All other conditions remain unaltered.
