The petitioner/A3, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 294(b), 353, 506(ii) @ 294(b), 353, 506(ii), ,467, 468, 471, 120(B) I.P.C in Crime No.398 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution as per the defacto complainant, who is the Special Sub Inspector of Police, Periyapalayam Police Station, is that the the petitioner along with other accused have cheated the devotee and black development officer by collecting money from the devotee without any valid license and approval based. Hence the case.

3. The learned counsel for the petitioner further submits that the petitioner is an innocent person and based on the confession statement recorded from the arrested accused, the petitioner has been implicated in this case. He would further submit that the co-accused have been arrested and later enlarged on bail by the lower Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that it appears that after the termination of the tender for collection of toll fee for parking the vehicles in the temple, they have produced fake certificate and started collection of toll fee for parking the vehicles. Hence, he opposed for grant of anticipatory bail to the petitioner. 5.Heard the learned Counsel for the petitioner and the learned Government Advocate (crl.side) and perused the materials available on record.

6.Taking into consideration the facts and circumstances of the case and also the submissions made by the learned counsel on either side and also the nature of the offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. 07.08.2023 nvi Crl.O.P.No.17178 of 2023 https://www.mhc.tn.gov.in/judis 2/2
