ORDER

This Criminal Original Petition has been filed seeking a direction to the Trial Court, viz., XXIII Metropolitan Magistrate, Saidapet, Chennai, to expedite the trial in C.C. No.6629 of 2014 within a time frame.

Today, when the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that Non Bailable Warrant is pending as against the third accused in C.C. No.6629 of 2014, on account of which, there is no progress in the trial. It is seen that the petitioner is a foreign national and he is keen that the case against him is disposed earlier so that he would know his fate.

Under such circumstances, the first respondent police is directed to take steps to file necessary application before the Trial Court for splitting up of the case in terms of Rule 17 of Criminal Rules of Practice and thereafter, the Trial Court is directed to split up the case and proceed with the trial as against the other accused expeditiously and complete the same within a period of six months, provided the accused cooperates in the trial by cross-examining the witnesses on the day they are examined-in-chief, as directed by the Supreme Court in Vinoth Kumar vs. State of Punjab [2015 (1) MLJ Crl.288] and provided further that there is no other impediment for the completion of the trial.
