Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the 1st and 2nd respondent to consider and pass order on the petitioner's representation dated 18.03.2025 to fix the basic salary at the time of retirement dated 31.05.2023 on par with his batch mate K.Vadivelan within a Stipulated time. By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the 1st and 2nd respondents to consider and pass order on the petitioner's representation dated 18.03.2025 to fix the basic salary at the time of retirement dated 31.05.2023 on par with his batch mate K.Vadivelan within a Stipulated time.

3. Heard the learned counsel for both sides and perused the materials available on record.

The learned counsel for the petitioner would submit that the petitioner has joined in the service of the Tamil Nadu Police Department on 01.08.1984 as Grade II Constable and after completing 41 years of service and on attaining the age of superannuation, he retired from service on 31.05.2023. Therefore, the petitioner has given a representation to the respondents on 18.03.2025 for refixation of pay on par with his immediate junior and further, he has also raised objection in respect of the notice issued for the recovery.
5. The learned Government Advocate appearing for the respondents 1, 3 and 4 would submit that they would consider the petitioner's representation, within a reasonable time.
6. In such view of the matter, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 18.03.2025 and pass orders on it's own 3/6
merits and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.
7. With the above direction, the Writ Petition is disposed of. No costs. 30.06.2025 (2/2) Index : Yes/No Speaking order /Non Speaking Order dm 4/6
