PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to transfer the investigation in Crime No.27 of 2016 from the file of the 1st respondent Police to C.B.C.I.D. (Crime) Rep.by the Additional D.G.P., C.B.C.I.D (Crime), Guindy Industrial Estate, Chennai-600 032 to depute a Competent Officer to investigate the same, within the time frame that may be fixed by this Court.

O R D E R

The grievances of the petitioner in the present writ petition is that there isn't any progress in the investigation and therefore, he sought for transfer of investigation from the first respondent to the CBCID.

2.In my view, such a ground may not be sufficient to transfer the investigation.

Nevertheless, if the first respondent herein is directed to complete the investigation and file a final report within the stipulated time, and if such an investigation shall be monitored by the Superior Officer, then the ends of justice would be secured.

3.In the light of the above observations, the first respondent herein is directed to complete the investigation in Crime No.27 of 2016 within a period of six weeks from the date of receipt of a copy of this order and to file a final report, such an investigation shall be monitored by the Deputy Superintendent of Police having jurisdiction over the first respondent herein.

4.With the above directions, the Criminal Original Petition stands disposed of accordingly. Consequently, connected Criminal Miscellaneous Petition is closed.
