said sum of Rs.96,400 /- lying with HDFC bank to the Petitioner's S.B.Account No.20116133689 held with the 3rd respondent viz., State Bank of India, Mint Terminus Branch amended as directing the 1st respondent police to recover the said sum of Rs.96,400/- lying with the 4th respondent and to deposit the same with the Jurisdictional Magistrate Court to the credit of Crime No.38 of 2023 on the file of the 1st respondent.

ORDER

When the matter was taken up for hearing, there was no representation for the petitioner. However, learned Government Advocate (Crl.side) appearing for the first respondent would submit that the petitioner has transferred a sum of Rs.96,400/- through G.Pay to an unknown person under the impression that the said person was his relative and later came to know that someone has defrauded him. Subsequently, he approached the fifth respondent bank, through which the money was transacted and requested to block the amount transferred by him and the same was also done by the 5th respondent bank. Now, the petitioner wants to re-transfer the said money to his account, which is not sustainable.

2. Recording the aforesaid submission, this writ petition is dismissed for non-prosecution. No costs.
