This application has been filed by the applicants / plaintiffs to institute the main suit before this Court in respect of Item II, III, IV and V of the suit properties which are situated outside the jurisdiction of this Court.

2. The suit has been filed by the applicants / plaintiffs for partition and separate possession of the suit schedule mentioned properties and allot 1/3rd share each to the plaintiffs 1 & 2, in all 2/3rd share to plaintiffs 1 & 2 herein and for appointing an Advocate Commissioner to divide the suit schedule mentioned properties by metes and bounds and allot 1/3rd share each to the plaintiffs 1 & 2 herein in all 2/3rd share over the suit schedule mentioned properties to the plaintiffs 1 & 2 herein and to grant mesne profits from the date of plaint till the date of payment.

3. According to the learned counsel for the applicants / plaintiffs, the suit has been filed for partition and separate possession against the defendant. Even though the cause of action is well within the jurisdiction https://www.mhc.tn.gov.in/judis

of this Court, Item II, III, IV and V of the suit properties are situated outside the jurisdiction of this Court. Hence, this leave application is filed.
