PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 11.03.2024 and to re-classify the land comprised in S.No.92B/13 situated at Ammayakaram Village, Chinna Salem Taluk, Kallakuruchi District.

O R D E R

The petitioner herein seeks a direction to respondents to consider his representation dated 11.03.2024 and re-classify the land comprised in Survey No.92B/13 situated in Ammayakaram Village, Chinna Salem Taluk, Kallakuruchi District.

2. According to the petitioner, he had been in possession and enjoyment of the above mentioned land and when his possession was disturbed by one Senthil Kumar, he filed a civil suit for injunction in O.S.No.197 of 2022 on the file of I Additional District Munsif Court, Kallakurichi and got an exparte decree for injunction. Thereafter, he submitted a representation dated 11.03.2024 seeking re-classification of the land and issuance of patta in his name. The said representation has not been considered by the official respondents. Aggrieved by the same, the petitioner is before this Court. 2/4

3. Mr.A.Selvendran, learned Additional Government Pleader, who takes notice for the respondents submitted that representation of the petitioner would be considered in accordance with law and final orders would be passed within a time fixed by this Court.

4. Though the petitioner sought for a direction to re-classify the land based on his representation, this Court is not inclined to issue any positive direction to the petitioner. However, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to 2nd respondent to consider the representation of the petitioner dated 11.03.2024 and pass final orders on merits and in accordance with law within a period of eight weeks from the date of receipt of copy of this order.
