PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent not to harass the petitioner.

ORDER

This petition has been filed to direct the respondent not to harass the petitioner.

2. The petitioner is the estranged husband of the second respondent viz., Megala. He has filed this petition since the respondent Police is calling the petitioner and his parents for enquiry at odd hours.

3. The contention of the petitioner is that the on 03.08.2018, the petitioner married one Megala. Thereafter, within 13 days of marriage, she left the matrimonial home and residing with her parents. Earlier she lodged a complaint to the respondent Police on 21.09.2021 and CSR.No.318 of 2021 was assigned and after enquiry, the case was closed. Now, the All Women Police is again calling the petitioner and his family members and harassing them for the same complaint. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate (Crl.Side) has submitted that the petitioner's wife Megala gave a petition to the Chief Minister Cell, which was forwarded to the respondent Police on 08.10.2021. Thereafter, the petitioner was summoned and called for enquiry. Since it is a matrimonial dispute, calling the petitioner for enquiry, cannot be termed as harassment.

5. In view of the same, the petitioner is directed to appear before the respondent police on 01.12.2021 and thereafter, as and when required. The respondent police is directed to conclude the enquiry within 15 days of the appearance of the petitioner.

6. With the above directions, this Criminal Original Petition is disposed of.
