Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus directing the 1 and 2 respondents to give Police protection to the petitioner property and also to the residence of J.R.Enclave in S.No.371 and 348/1 situated at No.19, Ayyapakkam village, Ambattur, Avadi Taluk, Tiruvallur district from illegal and unlawful acts of the 3rd respondent and his henchman.

ORDER

This Writ Petition is filed seeking mandamus to give Police protection to the petitioner herein since the third respondent, who is the grand-son of the vendor's vendor of the petitioner, is trying to create panic in the mind of the purchasers and proposed purchasers of the flat promoted by the petitioner herein.

2. The learned Government Advocate (Crl. Side) states that on the complaint given by the petitioner, C.S.R.No.734 of 2024 was registered on 29.07.2024. The third respondent was called for an enquiry. In the course of the enquiry, the third respondent has given an undertaking that he will not disturb the possession of the petitioner and he will workout his remedy before the Civil Court and he has also given undertaking that he will not visit the property.

3. Recording his undertaking, C.S.R.No.734 of 2024 was closed on 02.08.2024.

4. Taking note of the submissions made by the learned Government Advocate (Crl. Side), this Writ Petition is disposed of with a direction to the respondent Police to ensure that the third respondent abide by his undertaking. No costs.
