ORDER
This writ petition has been filed for the issue of a writ of mandamus directing the 1 st and 2 nd respondents to deal with the application submitted by the petitioner on 16.10.2024, where the petitioner is seeking for legal heirship certificate, pursuant to the demise of his father Venugopal.
2. Heard Mr.Shrivirudishni. V for Mr.Thirumalai Rajagopal, learned counsel for the petitioner and Mr.R.Neelakandan, learned Additional Advocate General for the 1 st and 2 nd respondents.
3. The case of the petitioner is that the deceased Venugopal was married to one Bhoothanam and out of this wedlock, the petitioner was born. The petitioner's mother died on 03.08.1996. After the demise of the petitioner's mother, the petitioner's father married the 3 rd respondent and out of the wedlock, the respondents 4 to 6 were born.
4. The further case of the petitioner is that the petitioner's father died on 13.09.2024 and left behind the petitioner and respondents 3 to 6 as legal heirs.
5. The learned counsel for the petitioner submitted that an application was filed before the 2 nd respondent seeking for legal heirship certificate, and since the same was not acted upon, the present writ petition has been filed.
6. Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the 2 nd respondent to act upon the application submitted by the petitioner dated 16.10.2024 and issue legal heirship certificate within a period of four weeks from the date of receipt of a copy of this order.
7. In the result, the writ petition is disposed of in the above terms. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. 03-07-2025 gd Index:Yes/No Speaking/Non-speaking order Internet:Yes
