This miscellaneous petition has been filed seeking modification of the order passed by this Court on 05.04.2024 in W.P.No.9705 of 2024.

2. Mr.G.Jeremiah, learned counsel for the petitioner would submit that the petitioner has already paid four installments and is not in a position to pay the 5th installment on account of financial crisis. Pertinently, the electricity consumption charges are directed to be settled to the respondents based on the affidavit filed by the petitioner that he will pay the charges by installments.

3. When the petitioner agreed to pay electricity consumption charges by way of installments and his undertaking has been recorded by this Court in the order passed in the writ petition, now he cannot turn around and say that he is not in a position to pay remaining installments. Such a contention need not be accepted in view of the fact that the petitioner have already given https://www.mhc.tn.gov.in/judis

Jeni an undertaking. More so, the regular electricity consumption charges are to be paid and there cannot be any misplaced sympathy. Granting installments itself is a concession extended by this Court and therefore, further concession cannot be granted. Consequently, Writ Miscellaneous Petition stands dismissed. No costs.
