The petitioners in both Crl.Ops, who were arrested and remanded to judicial custody on 28.07.2022 for the offences punishable under Sections 328 IPC and Section 20(1) of Cigarette and other Tobacco Products Act, 2003 in Crime No.199 of 2022w, seek bail.

2. The case of the prosecution is that the petitioners along with other accused were found in possession of 1,714 kgs of banned tobacco products. Hence, the case.

3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. That apart, the petitioners have been suffering incarceration from 28.07.2022. Hence, he prays for grant of bail to the petitioners. https://www.mhc.tn.gov.in/judis

The learned Additional Public Prosecutor appearing for the respondent would submit that, the contraband involved in this case is about 1,714 kgs of banned tobacco produtcts and further the petitioners are also in conscious and constructive possession. Hence, he vehemently opposed to grant bail to the petitioners.

5. Considering quantity of the contraband seized from the accused and further the petitioners was arrested only on 28.07.2022, this Court is not inclined to grant bail to the petitioners.
