The Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate (CCB & CBCID cases), Egmore, to conduct speedy trial in C.C.No.12726 of 2022.
2. Based on the complaint lodged by the petitioner/de fact complainant, a case in Crime No.139 of 2018 was registered by the respondent for the offences punishable under Sections 420, 465, 467, 468, 471 & 120B of IPC. After completion of investigation, a charge sheet was filed and taken cognizance in the year 2022 in C.C.No.12726 of 2022 on the file of the Judicial Magistrate (CCB & CBCID cases), Egmore. However, despite the lapse of time, there has been no progress in the trial and the second accused in this case is still shown as absconding. Hence, the present petition has been filed seeking a direction to expedite the trial.
3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the first respondent.
4. Considering the facts and circumstances of the case particularly 2/4
that the case pertains to the year 2018 and despite the filing of the charge sheet in the year 2022, the trial is still pending, the learned Judicial Magistrate (CCB & CBCID cases), Egmore, is directed to complete the trial in C.C.No.12726 of 2022 as expeditiously as possible.
