Challenging the impugned Refusal Check Slip dated 17.06.2023 passed by the 2nd respondent, this writ petition has been filed.
2. Heard learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 and 2 and perused the materials available on record.
3. When the petitioner presented a Sale Deed dated 14.06.2023 for registration, the same was refused to be registered by the 2nd respondent, on the ground that he failed to submit the documents to show that the sub division of the property belong to the respondents 3 to 5. It is the grievance of the petitioner that though he annexed the compromise decree and judgment dated 07.12.2022 in O.S.No.62 of 2022 on the file of the District Munsif-cumJudicial Magistrate Court, Vannur, pursuant to which, the Sale Deed was executed by the respondents 3 to 5 in favour of the petitioner, without 2/4
considering the same, the 2nd respondent passed the impugned order. Hence, the present writ petition.
4. As far as the reason assigned by the 2nd respondent in the imugned order is concerned, this Court has elaborately dealt with in Subramani Vs. The Sub Registrar, Rasipuram and Another (W.P.No.11056 of 2024 decided on 26.04.2024). In such view of the matter, the impugned order passed by the 2nd respondent is set aside and the 2nd respondent is directed to register the Sale Deed of the petitioner, within a period of ten days from the date of receipt of a copy of this order.
With the above direction, this writ petition is allowed. No costs. 11.06.2024 gya Index : Yes/No To 1.The District Registrar Villupuram Villupuram District 2.The Sub Registrar O/o.The Sub Registrar Vannur Taluk Villupuram District 3/4
