The petitioners, who were arrested and remanded to judicial custody on 09.07.2022 for the offences punishable under Sections 302 @ 147, 148, 294(b), 448, 302 of IPC in Crime No.520 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the de-facto complainant's son sustaining grievous injuries was found dead in his room. Hence, the complaint.

3. The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. Hence, he prays for grant of bail to the petitioners.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that there are totally 5 accused in this case, in which the petitioners are arrayed as A2 and A3. These petitioners along with other accused persons consumed alcohol with the deceased and due to previous enmity, there was a wordy quarrel between them. At that time, A2 attacked

the deceased with the iron rod on his head and A3 was also present in the scene of occurrence. Hence, he vehemently opposed for granting bail to the petitioner.

5. Under the influence of alcohol, the petitioners had assaulted the deceased. That apart, the petitioners were arrested only on 09.07.2022. Therefore, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition is dismissed.
