After hearing of both the parties, I find that this application is to condone the delay of 1770 days in filing to set aside the ex-parte order dated 20.08.2019 passed in the above civil suit. The written statement has not yet filed. The matter is under the stage of cross-examination of D.W.1. Separate proceedings has to be complied with.

2. Heard both sides.

3. Having satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 1770 days is condoned.

4. Accordingly, A.No.4032 of 2024 is condoned on condition that the learned counsel for the applicants is directed to pay a cost of Rs.5000/- to the learned counsel for the plaintiff on 16.08.2024.

5. Post the matter on 16.08.2024 under the caption 'for reporting compliance'.
