Respondent Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus on the respondent with respect to the process that need to be implemented to complying with their standing

orders, issue directions to Magistrate Courts dealing with complaints with respect to non-registration of FIRs by the police towards deciding on initiating punitive actions on erring police offices in accordance to the law so as to ensure there is adequate accountability on the defaulting Police. ORDER

(Order of the Court was made by the Hon'ble Chief Justice) When we informed petitioner that the prayer, being so wide, cannot be granted and, in any event, his concern is addressed by a judgment of the Apex Court in Lalita Kumari v. Government of Uttar Pradesh and others1, Mr.Gowrishankar sought leave to withdraw the petition.

2. Petition is dismissed as withdrawn. There shall be no order as to costs.

3. At the same time, petitioner pointed out that the Monitoring Committee in most of the Districts is not functioning.

4. Shri Prabakar states that if petitioner is able to identify the specific District, it will be able to monitor, otherwise, his instructions are all Monitoring Committees are functioning as per the legal requirements.

5. Petitioner states he shall address a communication to the Director General of Police as also the Additional Chief Secretary, Home, Government of Tamil Nadu, mentioning therein the list of Districts where the Monitoring Committee is not functioning and also the basis for him to make such statement.

6. Shri Prabakar states once that is received within two weeks of receiving the communication steps will be taken to set the things in order.

Consequently, W.M.P.No.26359 of 2022 filed by one A.Martin @ A.K.Martin to implead him as proposed respondent in the writ petition is closed.
