Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Habeas Corpus, to call for the entire records, relating to petitioner's son detention under Tamil Nadu Act 14 of 1982 vide detention order, dated 03.12.2016 on the file of the second respondent herein made in proceedings No.1205/BCDFGISSSV/2016 and quash the same as illegal and consequently direct the respondents herein to produce the said petitioner's son namely Uthaya @ Uthaya Kumar son of Pitchaimuthu, aged 25 years before this Court and set the petitioner's son at liberty from detention, now petitioner's son detained at Central Prison - II, Puzhal, Chennai - 600 066. (Order of the Court was made by NOOTY. RAMAMOHANA RAO, J.) The learned Additional Public Prosecutor for the respondents has brought to our notice that the State Government has passed https://hcservices.ecourts.gov.in/hcservices/
the order through G.O.Rt.No.282, Home, Prohibition & Excise (X) Department dated 20.01.2017 agreeing with the opinion of the Advisory Board that there is no sufficient cause for the detention of the accused and the detention order passed by the second respondent as against the petitioner dated 03.12.2016 has been revoked and hence, this Habeas Corpus Writ Petition does not survive for further adjudication.
2. Recording the submission made by the learned Additional Public Prosecutor for the respondents, this Habeas Corpus Writ Petition is dismissed. A copy of the order passed by the Government is kept on records.
