Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus calling for records on the file of the 3rd respondent in relation to the impugned order in Na.Ka.No.3593/A5/2018 dated 12.06.2018, and the consequential order in Na.Ka.No.3593/A2/2018, dated 30.01.2019, quash the same and consequently direct the respondents to extend the benefit of G.O.Ms.No.413, Finance Department dated 04.11.2010 by including the petitioner in the old pension scheme applicable to the secondary grade teachers appointed prior to 01.04.2003 and accordingly grant all pensionary and terminal benefits to the petitioner.

When the writ petition is taken up for hearing, the learned counsel appearing for the petitioner seeks permission of this Court to file an appeal before the 1st respondent and she has also made an endorsement to that effect.

2.In view of the endorsement so made by the learned counsel for the petitioner, the writ petition is disposed of with liberty to the petitioner to file an appeal before the appropriate authority as against the impugned order. If any appeal is filed, the concerned authority may consider the same and pass appropriate orders on merits and in accordance with law as expeditiously as possible. No costs. Consequently, connected Miscellaneous Petitions are closed.
