Advocate For Respondent : Mr.C.E.Pratap Government Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 448, 294(b), 387, 392, 506(ii) and 397 of IPC, in Crime No.514 of 2021 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant is working as a Site Incharge at PST Engineering Construction's Site Office. On 19.06.2021 at about 6.p.m., one unknown person suddenly entered into his site office and he had warned the defacto complainant and on 02.07.2021, 4 unknown persons have entered into the site office and stated that they are the rowdy elements and was known to the petitioner and threatened him with knife point and robbed a sum of Rs.2,000/- and they have continuously threatening the defacto complainant by stating that without any mediation talks with the petitioner work should not be started. Hence, the complaint. 3.The learned counsel appearing for the petitioner submits that the petitioner have not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. The learned Government Advocate (Crl.Side) submits that earlier this court dismissed the anticipatory bail application in Crl.OP.No.15602 of 2021 on the ground that the petitioner is a history sheeter and there are nine previous cases similar in nature pending against the petitioner. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5. Considering that previous cases pending as against petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
