This petition has been filed seeking to condone the delay of 462 days in filing the appeal.
2. Heard the learned counsel for the petitioner and the learned counsel for the second respondent/Insurance Company.
3. The petitioner would aver that the appeal papers got mixed up with other bundles and they were traced out after a thorough search. Hence, the delay of 462 days occurred in filing the appeal.
4. Accepting the averments made in the affidavit filed in support of this petition, this Civil Miscellaneous Petition is ordered and the delay of 462 days is condoned on condition to waive the interest for the delay period.
