Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents to remove the TASMAC Shop bearing number 2589 at Kattumannarkoil - Chidambaram Main Road, Poorthangudi Village, T.Nedunjeri, Kattumannarkoil Taluk, Cuddalore District.

ORDER

(Order of the court was made by the Hon'ble Chief Justice) We have heard Mr.G.Pugazhenthi, learned counsel for the petitioner; Mr.P.Muthukumar, learned State Government Pleader, assisted by Mrs.R.Anitha, learned Special Government Pleader for respondents 1 and 3 and, Mr.C.Ramesh, learned counsel for the second respondent.

2. The grievance of the petitioner is to remove the Tasmac Shop bearing No.2589 situated at Kattumannarkoil-Chidambaram Main Road, Poorthangudi Village, T.Nedunjeri, Kattumannarkoil Taluk, Cuddalore District.

3. It is submitted that a representation has been given by the petitioner on 20.03.2023.

4. Rules 8 and 9A of the Tamil Nadu Liquor Retail Vending (In Shops and Bars) Rules, 2003 prescribe objection to be raised before the District Collector. The petitioner may raise an objection as permissible under law. In case such objection is made, the District Collector may decide the same on its own merits and in accordance with law.

5. With these observations, the writ petition stands disposed of. There will be no order as to costs.
