2. In these proceedings, parties shall be referred to by their respective ranks in the main suit for the sake of convenience and clarity.
3. Captioned application has been taken out by second defendant with a prayer for 'Condonation of Delay' ['COD'] qua 71 days in representation of the written statement.
4. Learned counsel for plaintiff very fairly submits that the prayer is not opposed.
5. Leaving open the question as to whether delay in representation should be factored in for computation of 120 days vide amended proviso to Order VIII Rule 1 of 'amended Code of Civil Procedure, 1908' [hereinafter 'amended CPC' for the sake of brevity and convenience] as amended by 'Commercial Courts Act, 2015 (Act 4 of 2016)' [hereinafter 'CCA' for the sake of convenience and clarity].
