This petition has been filed to condone the delay of 10 days in filing the second appeal.

It is seen from the notice papers that notice taken to R1 has been returned with an endorsement refused and her name is appeared in the cause list.

Heard the learned counsel for the petitioner as well as the learned counsel for the respondents 2 to 4.

Being satisfied with the reasons assigned in the affidavit filed along with the petition, this court is inclined to condone the delay.

Accordingly, this petition is ordered.

Registry is directed to number the second appeal, if it is otherwise in order and list the same for admission.
