JUDGMENT

Today, the appellants have handed over a Demand Draft for Rs.5,00,000/- (Rupees Five Lakhs Only) dated 17.11.2025 issued by State Bank of India, Tharamani Branch bearing No.696583, favouring the first respondent viz., R.Renuka. The said Demand Draft has been received by the second respondent in full and final settlement and satisfaction of all claims relating to the decree for mesne profits.

2. With the payment of Rs.5,00,000/- and payment already made in pursuance of the conditional order passed by this Court at the time of granting stay, the issue regarding damages for use and occupation/mesne profits stands fully settled/satisfied. The parties are at liberty to work out their respective rights and contentions in the pending suit in O.S.No.37 of 2020 filed by the respondents and O.S.No.6442 of 2025 2/4

filed by the appellants.

3. Insofar as the amount of Rs.5,00,000/-(Rupees Five Lakhs Only) already deposited by the appellants in furtherance of the conditional order passed by this Court at the time of granting stay, the respondents are at liberty to have the same paid out to them by filing an appropriate application which will not be opposed by the appellants.
