O R D E R

(The Order of the Court was made by The Hon'ble The Chief Justice) The petitioner, Panchayat Board Member, alleges encroachment on public land by private respondents Nos.4 to 7. A counter affidavit is sought to be filed in Court by the said private respondents today, stating that they have not encroached on any public pathway or temple land as alleged, but are occupying their patta land.

2. We are of the view that the third respondent is to verify the aforesaid aspect by conducting an inspection at site, including whether patta has been wrongly issued, after notice to all concerned. The said exercise be concluded within three months from the date of receipt of the order.

3. The writ petition accordingly stands disposed of, leaving the parties to bear their own costs. Consequently, connected miscellaneous petition is closed.
