This petition has been filed seeking an extension of interim protection granted in WP.No.l9807 of 2023 by the order dated 05.07.2023.

2. In the affidavit filed in support of this petition, it is averred by the petitioner that in spite of protection orders granted by this Court on 05.07.2023, the second respondent proceeded with the auction and issued Form-6 and Form-7 notices on 07.07.2023. In respect of the same, the petitioner filed a Contempt Petition in Cont.P.No.1670 of 2023 and notice was ordered to the respondents in that Contempt Petition.

3. It is also stated by the petitioner that in pursuance of the order passed by this Court in the above Writ Petition, he filed a memo before the Cooperative Tribunal requesting the stay of surcharge order in I.A.No.1 of 2023 in CMA.No.13 of 2021. The Tribunal after orally instructing the learned Government Advocate not to proceed with the surcharge proceedings till the pronouncement judgment in the Civil Miscellaneous Appeal, adjourned the matter to 09.08.2023 for pronouncing judgment. https://www.mhc.tn.gov.in/judis 1/2

4. In these circumstances, the petitioner seeks extension of interim protection granted till the disposal of the Civil Miscellaneous Appeal by the Cooperative Tribunal.

5. In view of the averments made by the petitioner as stated above, this Court is inclined to extend the interim protection granted to the petitioner till 09.08.2023.
