WMP.No.28142 of 2016 in W.P.No.32453 of 2016 T.S.SIVAGNANAM,J Heard Mr.AR.L.Sundaresan, learned Senior Counsel, assisted by Mr.Raja Srinivas, learned counsel on record for the petitioners and Mr.C.T.Ramesh, learned Additional Government Pleader assisted by Mr.A. Tamilvanan, learned Government Advocate appearing for the respondents.

In this writ petition, the petitioners challenge an order dated 13.8.2016 passed by the third respondent refusing to grant residency certificate to the first petitioner, who is the father of the second petitioner, so as to enable the second petitioner to participate in the counselling for the MBBS course, which is to commence from tomorrow i.e. 23.9.2016. By the impugned order, the petitioner rejected the petitioner's claim for issuance of residency certificate.

Therefore, this Court proposed to see as to whether the petitioners have made out a prima facie case for grant of any interim direction so as to enable the second petitioner to participate in the counselling. Hence, this Court called for relevant files and the files have been circulated, from which, the report of the Inspector reveals that the house, which has been purchased by the first petitioner in the name of his wife, is not habitable. That apart, pursuant to the earlier direction issued by this Court in a writ petition, the petitioners were directed to produce documents of sterling quality. However, nothing was produced.

4. Therefore, this Court is of the view that the petitioners have not made out a prima facie case for grant of any interim direction or interim relief. This is more so because unless and until the petitioners fully satisfy that they are the ordinary residents of Puducherry, the second petitioner is not eligible to compete for admissions in the MBBS course, however meritorious he might have been.

5. In view of the above, the above miscellaneous petition is dismissed. 22.9.2016 2/2 Office to Note :
