entering upon or altering the nature and character of the petitioners property except in accordance with law.

Mr.P.T.Ramkumar, Standing Counsel Order This Writ Petition has been filed to direct the respondents not to interfere with the petitioner's peaceful possession and enjoyment of the property situated at Thirukachur Village, Singaperumal koil panchayat, Chengalpattu district, comprised in Survey No. 50A/1A measuring 84 cents and Survey No. 52B/1, measuring 26 cents covered under patta No. 343 and consequently direct the respondents to remove the unauthorized compound wall and all constructions put up in the petitioners property without following due process of law.

2. At the outset, the learned Standing Counsel for the respondents would submit that the Writ Petition itself is misconceived in as much as the boundary walls are constructed in the property belonging to the first respondent. Therefore, the petitioner cannot have any grievance and he would further submit that if the petitioner insists for joint survey, the same shall be conducted to identify the boundaries of the petitioner's property viz-a-viz the respondents' property.

3. The same is agreed to by both sides. In view thereof, it is open to the petitioner to take out an appropriate application under Survey and Boundaries Act, 1923. If such application is made, the respondents shall also be made as parties and they also be put on notice while the survey is conducted.
