ORDER
This Criminal Original Petition is filed for a direction to the trial Court to conduct the trial expeditiously.

The petitioner is the 3rd accused in the case registered by the DVAC for the offences under Sections 13(2) r/w.13(1)(c) & (D) of Prevention of Corruption Act and Sections 120-B, 167, 409, 420, 466, 471, 474 & 477A of IPC. Totally there are nine accused and as on date, three of them dead.

The learned Government Advocate (Crl.Side) appearing for the State submitted that the matter is ripe for framing of charge. Due to absence of one or another accused and filing of 317 of Cr.P.C., petition, the trial Court is unable to read over the charges, hence it is delayed. The learned Government Advocate (Crl.Side) also states that the case is posted on 11.09.2023. Once the charge is framed, the prosecution is ready to marshal their witnesses. The final report indicates that the prosecution has 143 witnesses to examine and 118 documents to rely upon.

In light of the nature of the case and volume of documents as well as number of witnesses proposed to examine, the trial Court is directed to frame charges on 11.09.2023, proceed with the trial and complete the same within a period of 18 months from the date of receipt of copy of this order, subject to cooperation of the accused. If they failed to cooperate, necessary action shall be taken for securing their cooperation 5.
From the above directions, this Criminal Original Petition is disposed of.
