O R D E R
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 419, 465, 468, 471, 420 of IPC and Section 66D of Information Technology Act, 2000 and Sections 3 1/6
and 5 of Emblems and Name (Prev. of Improper Use), 1950 in Crime No. 3 of 2025, on the file of the respondent Police, seeks anticipatory bail.

The allegation against the petitioner is that the petitioner and others had approached the de-facto complainant states that they have "Iridium" as a rare material, and stated that they need advance money to collect several thousands of crores from foreign nations through RBI by sale of "Iridium" and collected Rs.7 lakhs, thereby cheated the de-facto complainant. Hence, the complaint has been registered.

The learned counsel for the petitioner submitted that in this case two other accused person viz., A1 and A2 already arrested and subsequently, they were released on bail and that the petitioner is only ranked as A4. He further submitted that he is ready to deposit the entire cheated amount and also he is ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and reported that this petitioner is a habitual offender and in this case, the petitioner received a total sum of Rs.7 lakhs from the defacto complainant and in other case in Crime No.16 of 2023 pending on the file of the District Crime Branch, Coimbatore which involving the total amount of Rs.4.5 Crores and so far, no amount has been recovered. Hence, he oppose to grant bail to the petitioner.

Considering the fact that the petitioner has fraudulently obtained a sum of Rs.7 lakhs from the defacto complainant and so far no amount has been recovered and now investigation revealed that, huge amounts i.e., 4.5 crore were cheated by the petitioner in another case and also the fact that the petitioner is a habitual offender, though he is in custody from 13.09.2025, this Court is not inclined to grant bail to the petitioner. 3/6
