R. Subramanian (Died) v. The Special Commissioner And Commissioner

C.M.P.No.2237 of 2021 in S.A.No.133 of 2021 C.KUMARAPPAN, J., The learned Senior Counsel appearing for the appellants would submit that the Execution Petition is posted on 05.01.2024 and there is a threat of eviction. The learned Senior Counsel would further submit that the suit property is a residential house of the appellants and if any eviction is taken place, they have no accommodation to stay and they will be on road.

2. The learned counsel for the respondents has stoutly objected his contention and would seek time to file a counter till 10.01.2024.

3. Having considered the submission made on either side and also having regard to the facts of the case, this Court deems it appropriate to grant an ad interim stay.

4. Hence, this Court grants ad interim stay till 10.01.2024. Post the matter on 10.01.2024.
