This miscellaneous petition has been filed to condone the delay of 96 days in representing the appeal.

2. Heard the learned counsel for the petitioner and the learned counsel appearing for the 1st respondent.

3. Learned counsel for the petitioner submitted that since the previous counsel engaged by the petitioner was not well, the petitioner was not able to get the appeal papers, due to which, there occurred a delay of 96 days in representing the appeal.

4. Considering the submissions of the petitioner and on being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay in representing the appeal is condoned. Accordingly, the petition stands allowed.
