PRAYER Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to permit the petitioner to pay the arrears of Rs.4,07,66,365/- as per Regulation 22(6)(ii) of the Tamil Nadu Electricity Supply Code 2004 along with restoration charges and other charges and restore supply on payment of the 1st instalment. 1/5

ORDER

This writ petition has been filed for the issuance of a Writ of Mandamus directing the second respondent to paythe arrears of Rs.4,07,66,365/- as per Regulation 22(6)(ii) of the Tamil Nadu Electricity Supply Code, 2004 along with restoration charges and other charges and to restore supply on payment of the first instalment.

2. When the case came up for hearing on 26.06.2025, this Court directed the learned Standing Counsel to take instructions on the security deposit that is available in order to enable this Court to pass final orders.

3. When the matter was taken up for hearing today, the learned Standing Counsel, on instructions, would submit that a total sum of Rs.4.51 Crores is available towards security deposit and the petitioner has to pay a sum of Rs.4.17 Crores towards arrears.

In the light of the above, considering the earlier orders passed by this Court on the very same issue, this Court is inclined to dispose of this writ petition with a direction to the petitioner to pay 40% of the total arrears outstanding to the respondent Board. On receipt of the same, the respondent Board shall restore the service connection. The balance 60% of the amount shall be collected in 10 (ten) monthly instalments. The petitioner shall file an affidavit in Form V of the Appendix to the Code in order to facilitate the payment in instalments.
