Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first respondent to consider the petitioner's representation dated 9.5.2025 and not entitle in any document to be registered in S.No.332/3A1 admeasuring an extent of 1.31 acres, situated at Muthaliyarkuppam Village, Cheyyur Taluk, Chengalpattu District based on the partition deed No.3169/2022 dated 11.8.2022.

ORDER

By the consent of both parties, the present writ petition is taken up for final disposal at the admission stage itself. In view of the nature of the order that is going to be passed in the present writ petition, notice to the second respondent stands dispensed with. Page No.1 of 6

The present writ petition has been filed praying for a writ of mandamus to direct the first respondent to consider the petitioner's representation dated 09.05.2025 and not to entertain any document to be registered in respect of property comprised in S.No.332/3A1 admeasuring an extent of 1.31 acres, situated at Muthaliyarkuppam Village, Cheyyur Taluk, Chengalpattu District based on the Partition Deed No.3169/2022 dated 11.08.2022.

It is submitted by Mr.M.Selvam, learned counsel for the petitioner, that pursuant to the Partition Deed, petitioner claims that he has the right and title vested with him in respect of the following properties:- PARTICULARS [a] A Schedule in the Partition Deed To the share of N.Mohan @ Mohandas dated 11.08.2022 with Survey Nos.333/1, 332/3A1 and 332/3A3 total extent 1.81 acres.

[b] B Schedule in the Partition Deed To the share of the petitioners herein dated 11.08.2022 jointly with Survey No.333/1, 332/3A1, 332/3A3, total extent 4.52 cents.

PARTICULARS [c] C Schedule in the Partition Deed Jointly to the share of S.Brahmanayagi dated 11.08.2022 V.Chitra and S.Thangaraj with S.Nos.155/3, 333/1, 332/3A1, 332/3A3, total extent 3.63 cents.

[d] D Schedule in the Partition Deed To the share of the second respondent dated 11.08.2022 with S.No.155/3, 333/1, 332/3A1, 332/3A3, total extent 5.71 1⁄2 cents.

[e] E Schedule in the Partition Deed Jointly to the share of the parties dated 11.08.2022 with S.No.333/1, 332/3A1, total extent 0.21 cents.

It is also the case of the petitioner that the second respondent, who also has a share in the "D" Schedule properties, is trying to sell the above mentioned properties without informing the other co-owners. Representation was thus taken out not to register any further documents in respect of the properties which forms part of the Partition Deed.

5. Mr.U.Baranidharan, learned Special Government Pleader would submit that the only course that may be open to the Page No.3 of 6

petitioner is to file a Protest Letter, if any registration is sought to be made.

6. However, it is premature as the petitioner was not able to point out any registration earlier made nor any proposed registration. In view thereof, it is always open to the petitioner to submit a Protest Letter, in respect of any registration which is sought to be made in respect of the subject property. If any such protest Letter/representation is made, the same would be considered, on merits and in accordance with law, by the appropriate Authority after considering the representation and after issuing notice to both the petitioner as well as the entities/persons, who seek to register any document/deed in respect of the subject property.

7. The writ petition, accordingly, stands disposed of. There shall be no order as to costs. Consequently, W.M.P.No.25951 of 2025 is closed.
