When the matter is taken up for hearing, it is represented by the learned Standing Counsel appearing for the 4th respondent that against the order of the 4th respondent, there is an appeal remedy available under Section 80-A of the Town and Country Planning Act, 1971 and the petitioner, without exhausting the same, has filed this petition.

2. In view of the above submission, when there is a provision to file an appeal under Section 80-A of the Town and Country Planning Act, 1971 and obtain an interim order, the present Writ Petition is not maintainable at this stage and the same is liable to be dismissed. 2/4
