ORDER
This writ petition has been filed to issue writ of mandamus directing the respondents to grant necessary permission to the petitioner for the removal of excess sand from Plot No.5/3A and for its transportation to the agricultural lands belonging to the petitioner in Plot No.20/4D, measuring to an extent of 79 cents.
2. When the matter was taken up for hearing today, the learned Additional Government Pleader appearing on behalf of the respondents produced the written instructions received from the Deputy Director of Geology and Mining Page No.2 of 6
Department and the relevant portion is extracted hereunder: "3. In this connection, it is submitted that no application from the Applicant / Writ Petitioner or any recommendations report from the District Revenue Officer or any other Revenue Officials, was received in this office, till date, as contended by the Writ Petitioner.
4. Further, it is submitted that, the Applicant / Writ Petitioner may apply in the MiMaS Portal, maintained by the Department of Geology and Mining, Governtment of Tamil Nadu (https://www.mimas.tn.gov.in) in the appropriate module, for seeking permission for the purpose as contended in the Writ Petition, for which necessary action will be taken as per the extant Acts and Rules in force. Hence, the writ petition deserves no consideration and it is liable to be dismissed."
3. In light of the above stand taken by the respondents, there shall be a direction to the petitioner to apply in the Mineral Management System (MiMaS) Portal maintained by the Department of Geology and Mining, in the appropriate Page No.3 of 6
module and seek for permission. On receipt of the same, necessary decision will be taken by the respondents 1 and 2 and it will be informed to the petitioner within a period of four (4) weeks from the date of the receipt of the online application of the petitioner.
4. In result, this Writ Petition stands disposed of in the above terms. No costs.
