Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents herein to consider the grievance of the petitioner and pleased to grant time for submitting the discontinued certificate or Transfer Certificate or any other equivalent certificate from the 3rd respondent and till the permit the petitioner to join 5 years B.A., LL.B., Degree Course in the 2nd respondent college for the academic year of 2020-21. ORDER
This writ petition is filed for a mandamus directing the respondents to grant time for submitting Discontinued Certificate or Transfer Certificate or any other equivalent certificate from the third respondent.
2.The case of the petitioner is that after completing the higher secondary education, he pursued Footwear Design and Development Institute at Chennai, an affiliated University situated at Noida in the year 2018 and due to his financial condition, he could not continue the said course and discontinued in the month of December, 2018. Thereafter, the petitioner has applied for five years B.A., LL.B., Degree Course in the first respondent Dr.Ambedkar Law University for the academic year 2020-21. After obtaining the allotment order, when the petitioner approached the second respondent College, the second respondent insisted to produce a Discontinued Certificate and Transfer Certificate or other equivalent certificate from the third respondent otherwise the admission for the five year LL.B., Degree course would be denied to the petitioner.
The petitioner has also approached third respondent and requested for issuance of Discontinuance Certificate but the third respondent has not issued certificate so far and sought for some time that the affiliated University is in Uttar Pradesh and they have to obtain the certificate from the University at Noida and to furnish the same. Therefore, this petitioner approached this Court for the above said relief. This Court while entertaining this Writ Petition, granted an interim order restraining the first respondent from canceling allotment order dated 14.12.2020 for a period of three weeks. But even after a lapse of 3 weeks, the Writ Petition was not listed and interim order was not extended and the petitioner is also not in a position to obtain Discontinued Certificate or Transfer Certificate from the third respondent Institute.
3.Mr.V.M.G.Ramakannan, learned counsel appearing for the first respondent submit that in view of the interim order passed by this Court, they are not in a position to fill up a seat for deserving students, they have also provided considerable time, even then the petitioner is not in a position to produce the said certificate and permit the University to fill up the seat. 4.In view of the difficulties faced by the petitioner with the third respondent, the admission of B.A. LL.B course for the respondent University cannot be stalled for months together and therefore, this Writ Petition is disposed of with liberty to the petitioner to lodge a criminal complaint as against the 3rd respondent for spoiling his prospectus for pursuing a B.A. LL.B., course.
5.With the above observations, this Writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
