This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 01.06.2024, seeking bail in Crime No.385 of 2024 for the alleged offences punishable under Sections 454 & 380 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner, who has nothing to do with the alleged offence, has been suffering incarceration from 01.06.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court, hence, he prayed for bail.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police objected for granting bail to the petitioner stating that the accused had broke open the de facto complainant's house and committed theft of gold jewels, silver articles and a cash of Rs.5000/-. The total value of the stolen articles comes around 9 lakhs. He further submitted that only a part of the jewels were recovered from the accused. https://www.mhc.tn.gov.in/judis

4. He further submitted that the investigation in this case is not yet completed and further, 7 previous cases are pending against the petitioner. Therefore, if the petitioner is released on bail, there is a possibility of him absconding and not available for further investigation.

5. Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) that the investigation is at initial stage and the stolen articles were not fully recovered from the accused, this Court is not inclined to grant bail to the petitioner.
