The petitioner/A1, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 6(4) of TNSC (RDCS) Order 1982 read with Section 7[1][a][ii] of Essential Commodities Act, 1955, in Crime No.27 of 2023 seeks anticipatory bail.

2. The case of the prosecution is that on 14.07.2023, the petitioner is found in possession of 3150 bags of PDS rice. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Therefore, he prays for grant of bail to the petitioner. 4.The learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that the prosecution has come forward with a specific case that this petitioner is working as a Junior Quality Inspector in Tamil Nadu Civil Supplies Department and in connivance with A1, he has https://www.mhc.tn.gov.in/judis 1/2

ars played an active role in taking ration rice, which is kept in the godown and therefore, he vehemently opposed for grant of anticipatory bail to the petitioner. 5.Heard the learned Counsel for the petitioner and the learned Government Advocate (Crl.side) and perused the materials available on record.

6. Taking into consideration the nature and gravity of the offence and the specific overtact attributed against this petitioner/A2, who is a government servant in charge of the Tamil Nadu Civil Supplies Godown, this Court is not inclined to grant bail to the petitioner.
