This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 16.06.2024, seeking bail in Crime No.372 of 2024 for the alleged offences punishable under Sections 408 & 413 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He further submitted that the petitioner, who has nothing to do with the alleged offence, has been suffering incarceration from 16.06.2024 and she is ready to abide by any stringent conditions that may be imposed by this Court, hence, he prayed for bail.

Learned Government Advocate (Crl.Side) appearing for the respondent police objected for granting bail to the petitioner stating that, the petitioner/A1, who was working in the de facto complainant's company, colluded with nine other accused, created a fake delivery challan and gate pass in the name of M/s.Farida Shoes Pvt. Ltd and taken the materials from the de facto complainant's company and caused loss to the tune of Rs.86 lakhs.

4. He further submitted that the investigation in this case is not yet completed and no recovery was made from the accused. Therefore, if the petitioner is released on bail, there is a possibility of her absconding and not available for further investigation.

5. Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) that the investigation is at initial stage and the amount was not yet recovered, this Court is not inclined to grant bail to the petitioner.
