N.Balaji @ Balaji Nagarajan died on 25.05.2021. His mother N.Saradha predeceased him and had died on 04.01.2008. The first petitioner is his widow and the second and third petitioners are his daughter and son. At the time of his death, he had left behind share in various companies which had been more specifically stated in the schedule to the petition. Claiming that the petitioners are the only legal heirs and class-I heirs, the present petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925, seeking grant of Succession Certificate.
2. The second and third petitioners namely, the daughter and son had given consent affidavits for the grant of Succession Certificate in favour of the first petitioner. Necessary publication had been effected and thereafter, the parties were directed to adduce evidence. The first petitioner examined herself as PW-1. She had marked the death certificate of N.Balaji as Ex.P-1, the death certificate of N.Saradha was marked as Ex.P-7, the legal heirship certificate of Balaji was marked as Ex.P-2, the consent affidavits of the second and third petitioners were marked as Exs.Phttps://www.mhc.tn.gov.in/judis

vsg 8 and P-9. The document with respect to holding of ICICI Bank was marked as Ex.P-3 and the paper publication was marked as Ex.P10.
3. In view of the evidence adduced, this Petition stands allowed as prayed for and a direction for grant of Succession Certificate to the first petitioner with power to collect the securities and to receive the interest and dividends on and negotiate and transfer the securities specified in the schedule is issued.
